Before Ordering
Please read through the terms and conditions carefully before placing your order. By using this website and/or placing an order, you agree to be bound by the terms and conditions set out below. We may change these terms from time to time without notification to you. Any changes will take effect on the date they are posted on to the site.
Your Account
Due to the small team that run the business there is a limited number of shops that we can supply at anyone time. At busy times of the year there is sometimes a waiting list to join. If you have not used your account within the first 30 days of registering your account will be cancelled to make way for another company. You will be contacted by email beforehand to give notice.
The Nephele wholesale website is a B2B business, we ask that you do not share your account with others or show images directly to your customers. This may lead to us closing your account. We do not permit use of the images for your own social media or websites - especially as we can not always guarantee the bags will be available and the colours can vary from screen to screen.
Delivery
We will deliver the goods to the address provided by the customer for delivery at the time the order is placed. The purchased items will be posted as soon as possible after the order is accepted. You will become the owner of the goods you have ordered when they have been delivered to you. Risk of damage to or loss of the goods shall pass to you at the time of delivery. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. Please be aware that any items sent recorded at your request become the property of you once signed for from our courier. Should an inaccurate signature be given to us, the company cannot be held responsible if we have diligently sent the goods to the address given on the order form.
Purchasers are responsible for any duties and/or taxes levied at the point of entry into the destination country.
Cancellations
We reserve the right to cancel the contract between us and the client if:
We have insufficient stock to deliver the goods you have ordered.
We cannot deliver to your area.
One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by e-mail and a refund will be issued immediately. We will not be obliged to offer any additional compensation for disappointment suffered.
Return and Exchange
We must be notified of all returns prior to posting please email: info@nephelewholesale.com if this process is not followed this may delay your return being processed.
Returns and Exchanges can be accepted provided the items are returned in perfect condition and unused within 7 days.
We will not accept returns that have been merchandised, priced, soiled or used in anyway. Please also note that items must be returned with all tags intact and in their original packaging.
Please allow up to 7 working days upon receipt of your package for your exchange or refund to be processed.
Refunds (if applicable)
Once your return is processed, then your refund will be issued, and a credit will be applied to your account within 7-10 working days.
Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange an item please state that you require an exchange when getting in contact and in your return parcel.
Please note exchanges can only be made for the same style, due to each item being unique an exact replacement is not possible. We will endeavour to match as closely as possible in colour and print.
Liability
If the goods we deliver are not what you ordered, are damaged, defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address or by email within 10 working days of the delivery of the goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address within 40 days of the date on which you ordered the goods.
If you notify us of a problem under this condition, our only obligation will be, at your option:
To make good any shortage or non-delivery to replace or repair any goods that are damaged or defective to refund to you the amount paid for the goods in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) whatsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the import or export of particular goods. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
We shall have no liability to you for any failure to deliver goods you have ordered, any delay in doing so, or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control. This includes, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
